LEGENDARY BOSTON BRUINS HOCKEY GREAT BOBBY ORR TO VISIT BIDDEFORD

Two time Stanley Cup winner Bobby Orr will be visiting Deering Lumber's Biddeford location on Tuesday, June 8th, from 7:00-8:30AM to sign autographs and chat with fans. Orr was the first defencemen to score 40 goals in a single season, and the youngest inductee into the Hockey Hall of Fame. He was also the first player in history to win four major NHL awards in one season. Orr played for the Boston Bruins from 1966 through 1976.

NOTICE:
By April 2010, all firms doing work in pre-1978 housing or child-occupied facilities must be lead-safe certified by the EPA.

WHO NEEDS TO BE TRAINED:
If a company is working on/for government funded rehab jobs such as Maine Housing, PROP and CAP's everyone on site will need this eight hour training course.
If the company is not working on these types of jobs, but rather working strictly for homeowners paying for the work, without government grants, then only one person in the company needs to take the class. Larger companies may want at least two trained persons because the trained renovator is expected on the worksite throughout the work process.

CLASS DESCRIPTION:
Renovation, Repair and Painting (RRP) - This 1-day course is designed for workers doing renovation, repair and painting work in pre-1978 housing. It includes information on lead and its health effects, occupant protection planning, lead-safe work practices, waste handling and disposal, and lead dust clearance standards. It also covers the OSHA lead in construction standard, personal protective equipment and hygiene practices, and state and federal regulations that apply to renovation, repair and painting in pre-1978 housing. This course meets the training requirements of the federal Environmental Protection Agency (EPA) Renovation, Repair and Painting rule for work beginning on or after April 22, 2010.

As most of you know the issues surrounding the use of independent contractors is nothing new. We have always encouraged members to apply for a Predetermination of Independent Contractor Status for any independent contractors utilized that were unable to provide evidence of workers' compensation insurance.

However, there is now a new law to become effective January 1, 2010 specific to Independent Contractors in the Construction Industry - (All companies need to be aware of this new law regardless of whether or not you are in the Construction Industry) - see below.

IMPORTANT STATUTORY CHANGE BECOMES EFFECTIVE JANUARY 1, 2010

On June 19, 2009, Governor Baldacci signed L.D. 1456 (P.L. 2009, Ch. 452) An Act to Ensure That Construction Workers Are Protected by Workers' Compensation Insurance. This legislation seeks to ensure appropriate workers' compensation insurance coverage for all individuals performing construction work on a construction site.

P.L. 2009, Ch. 452 creates a conjunctive twelve (12) part test to determine whether or not an individual is an employee or a construction subcontractor. The full text of the new law can be found on-line at:

http://www.mainelegislature.org/legis/bills/bills_124th/chapters/PUBLIC452.asp To implement the law, the Board has adopted a new application that must be used when applying for a rebuttable presumption that an individual is a construction subcontractor. WHAT TO DO:

If you hire independent contractors or subcontractors in the Construction industry (this applies to those companies who will hire electricians, plumbers, carpenters, etc to do work in/at their facilities) and they are unable to provide you with proof of workers' compensation coverage……….

*Complete the attached form "Application for Predetermination of Construction Subcontractor to Establish a Rebuttable Presumption" and send to the Workers' Compensation Board for approval. If approved as an independent contractor you will receive a predetermination certificate.

Note: If the construction applicant fails to meet any one of the 12 requirements listed in the application, that worker is presumed to be an employee and must be covered by the Workers' Compensation policy of the contractor or person who hired them.
